Justice Stinson decision on Standard Plate – Procedural By-Law

Justice Stinson has released his decision on the application of the TTA to quash a portion of the taxi by-law
The important paragraph is #98 in which he finds that because of the breach of the notice requirement contained in the Procedural Bylaw, that  the 2024 mandatory conversion date portion of the bylaw was enacted illegally and should be quashed. All the other portions of the Bylaw were upheld.
Section 98: “I therefore conclude that this breach of the notice requirement contained in the Procedural By-Law was substantive and went to the root of the validity of that section of the by-law amendment which provided for a mandatory conversion date. As a result, I find that the 2024 conversion date aspect of the by-law was enacted illegally and should be quashed.”
The Toronto Taxi Alliance and its Counsel will review Justice Stinson’s decision, and will have further comment  in the days ahead.
